Financial Services and Markets Act 2000 (Financial Promotion) Order 2005 — restricts the communication of financial promotions to certain categories of investor only, including High Net Worth and Sophisticated Investors.
FCA Policy Statement PS23/6 (effective February 2024) — strengthened requirements for self-certification of investor status before alternative investment promotions may be viewed, including mandatory 24-hour cooling-off provisions.
COBS 4.12A — requires firms to take reasonable steps to ensure financial promotions for high-risk investments are only directed at investors who have self-certified their eligibility under the prescribed categories.
